    Action Alliance To INEC: ‘Tamper With Our List Of State Chairmen, National Executive C’ttee And Face Contempt Proceedings’

    The Action Alliance (AA) has warn the Chairman of the Independent National Electoral Commission (INEC) and the Commission not to tamper with the list of its State Chairmen across the 36 State and the FCT in the Commission’s State offices including the list of the National Executive Committee (NEC) of the party in the Commission official website .

    This warning is necessary because the party has gotten intelligence that the Commission is considering tempering with the list of its duly elected 36 State Chairmen and the FCT currently in the Commission ‘s State offices and the List of National Executive Committee (NEC) Currently in the official website of the Commission.

    We wish to remind the Commission that there are three Court of Appeal judgements sitting in Abuja division that has conclusively settled the issue that has to do with the leadership tussle in Action Alliance (AA) in favour of Chief Barr Kenneth Udeze led leadership of the party which the Commission were represented by its counsels at the Court proceedings.

    The three Court of Appeal judgements in favour of Chief Barr Kenneth Udeze led leadership of the party were:

    1.Hon.Adekunle Rufai Omoaje &2 ORS VS Chief Uzewuru Nwachukwu & 3 ORS, Appeal Number: CA/ABJ/CV/955/2022,Judgement delivered on 26th day of January,2024 .

    2.Hon.Federick Igwiwiyisi VS Osaro Uwaifo & 2 ORS, Appeal Number:CA/ABJ/CV/869/2024, Judgement delivered on 6th day of September,2024 and where the appeal of the appellant was further dismissed by the supreme court of Nigeria in appeal number SC/CV/922/2024 for want of prosecution on 26th February, 2025.

    3.Action Alliance & 3 ORS VS INEC & 3 ORS, Appeal Number;CA/ABJ/CV/1163/2024, Judgement delivered on 13th day of November,2024.The Certified True Copies (CTC) of the said Court of Appeal judgements are already in the public to see.

    The three Court of Appeal Judgements listed above conclusively settled the leadership tussle in Action Alliance (AA) in favour of Chief Barr Kenneth Udeze-led leadership of the party.

    That instead of the losing parties one Adekunle Rufai Omoaje and his Cohorts to accept these Court of Appeal Judgements in good faith, in connivance with some bad eggs in the legal department of the Commission, they secretly filed another action at the Federal High Court Osogbo after losing at the Court of Appeal and obtained favourable judgement against the Court of Appeal judgements .

    That the affected parties have already filed the motion for setting aside the judgement and stay of Execution of same.

    That it is elementary in law that there is hierarchy of Courts,the Federal High Court is inferior to the Court of Appeal and after the Court of Appeal delivers its judgement on same subject matter the Federal High Court can not set it aside.

    That considering the hierarchy of Courts, the Judgement obtained from the Federal High Court Osogbo against three Abuja division of the Court of Appeal can not hold water and the Commission is urge not to recognize same or act upon it in the interest of justice.

    That the Action Alliance (AA) and the affected parties through their Counsel have already written to the Commission, warning the Commission not to recognize Federal High Court Judgement against the Court of Appeal judgements.

    That Action Alliance (AA) has since Conducted its National Convention on 22nd, February,2025 and affirmed Chief Barr Kenneth Udeze led leadership of the party for a fixed term in office and the said National Convention was duly monitored by the officials of the Independent National Electoral Commission (INEC).

    The Certified True Copy (CTC) of the Commission monitoring report of the said National Convention is already in the public to see.
