The FCT High Court Sitting in Maitama Abuja Presided over by Hon.Justice Chizoba N. Oji on 6th day of August,2025 has ordered the Nigeria Police, Inspector General of police, Force Criminal Investigation Department Abuja and ACP Yakubu Sule either by themselves, officers, agents, servants, privies or otherwise however described to maintain the status quo and/or stay further action in respect of the invitation letter dated 10th, July, 2025.
National Secretary of the Action Alliance, Vernimbe A James disclosed this in a statement signed on Friday.
The Court further directed a halt to any further invitation, interrogation or arrest of Chief Barr Kenneth Udeze (National Chairman of AA), Vernimbe A James, (National secretary of AA), Ekeng Effiom Effiom (National Treasurer of AA), Alh.Ali Abacha National Financial Secretary of AA) and Barr.Emeka Anukwuem National Legal adviser of AA in Connection with the internal political disputes over the leadership and/or management of the affairs of the Action Alliance (AA) , pending the hearing and Determination of the originating Motion on Notice pending before the court.
The Court also granted leave to the applicants, (Chief Barr Kenneth Udeze-led leadership of AA) to effect Services of all Court processes filed and to be served in this Suit upon the Inspector General of Police, Force Criminal Investigation Department Abuja and ACP Yakubu Sule by delivering to the legal department of the Nigeria Police Force, at Force headquarters, Luis Edet House, Abuja.
The Court granted leave to the applicants, (Chief Barr Kenneth Udeze led leadership of AA) to effect Services of all Court processes filed and to be served in this Suit upon the 5th Respondent (Adekunle Rufai Omoaje who instigated the Police) by Substituted means by pasting at Conspicuous place at Plot 955,No17 Femi Otedola Crescent, 7th Avenue Gwarinpa Estate, Abuja.
The Court further gave an order deeming the services(s) on the Inspector General of Police, Force Criminal Investigation Department Abuja, ACP Yakubu Sule and Adekunle Rufai Omoaje (the 2nd, 3rd, 4th and 5th Respondents) as proper service and the Court further adjourned the Substantive Motion for enforcement of Fundamental Rights for 11am on 26th August, 2025 for hearing and ordered hearing notices to be issued to the Respondents.
The statement read:”Adekunle Rufai Omoaje, after losing leadership of the party through various Courts Judgements, (one FCT High Court,Three Federal High Court Abuja, Four Court of Appeal Abuja and one Supreme Court Judgement all in favour of Chief Barr Kenneth Udeze-led leadership of the party), Adekunle Rufai Omoaje resorted to Nigeria Police to stop the legitimate leadership of the party led by Chief Barr Kenneth Udeze from performing our day to day affairs of the party hence we decided to seek judicial intervention to stop this madness from Adekunle Rufai Omoaje (expelled former member of the party).
“The same Adekunle Rufai Omoaje in another pending appeal at the Supreme Court:SC/CV/162/2024 between Adekunle Rufai Omoaje & others VS Chief Uzewuru Nwachukwu, Kenneth Udeze, Action Alliance and INEC all as respondents is challenging the leadership of the party led by Chief Barr Kenneth Udeze.
“The matter is yet to be heard and determined, instead of Adekunle Rufai Omoaje to wait for the final determination of his appeal pending at the Supreme Court of Nigeria, he resorted to Police for self help.
“Again, the same Adekunle Rufai Omoaje despite his appeal pending at the Supreme Court of Nigeria, is also mounting pressure on the Independent National Electoral Commission (INEC) to upload his name as the National Chairman of Action Alliance, along with his expelled Executives.
“The party urges the Commission to resist and ignore any temptation from these expelled former members of the party and external forces to continue recognition of the valid, legitimate and subsisting National leadership of the party led by Chief Barr Kenneth Udeze as affirmed by multiple court Judgements and the 22nd February, 2025 National Convention of the party duly monitored by the officials of the Commission led by a Deputy Director in the Commission which the Commission monitoring report is in the public.”
